1. Acceptance of Terms

By accessing and using Warborn ("the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Platform. We reserve the right to modify these Terms at any time, and your continued use of the Platform constitutes acceptance of any modifications.

2. Eligibility

You must be at least 18 years old or the age of majority in your jurisdiction to use the Platform. By using Warborn, you represent and warrant that you meet these eligibility requirements. The Platform is not available in jurisdictions where online gaming with cryptocurrency is prohibited.

3. Account and Wallet

Access to certain features requires connecting a compatible cryptocurrency wallet. You are solely responsible for maintaining the security of your wallet and any actions taken using your wallet address. Warborn is not responsible for any loss of funds due to compromised wallet security or user error.

4. NFT Ownership

Cards on Warborn are represented as ERC-1155 NFTs on the Base blockchain. Purchasing or earning a card grants you ownership of the NFT, which includes the right to use, trade, or sell the card within the Platform. Ownership of an NFT does not grant intellectual property rights over the underlying artwork or game mechanics.

5. Battles and Betting

The Platform allows users to participate in player-versus-player battles with ETH wagering. By participating in battles, you acknowledge that:

• All bets are final and cannot be reversed once a battle begins
• A platform fee is deducted from winning payouts
• You are solely responsible for any losses incurred
• You will only wager funds you can afford to lose
• Battle outcomes are determined by the smart contract

6. Prohibited Conduct

Users are prohibited from:

• Using bots, scripts, or automated tools to interact with the Platform
• Exploiting bugs or vulnerabilities in the smart contracts
• Colluding with other users to manipulate battle outcomes
• Money laundering or other illegal financial activities
• Harassing, threatening, or abusing other users
• Creating multiple accounts to circumvent restrictions

7. Fees

The Platform charges fees for certain services including but not limited to battle winnings and marketplace transactions. All fees are clearly disclosed before transaction confirmation. Blockchain network fees (gas) are additional and determined by network conditions.

8. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE UNINTERRUPTED ACCESS, ERROR-FREE OPERATION, OR THAT DEFECTS WILL BE CORRECTED. CRYPTOCURRENCY AND NFT VALUES ARE VOLATILE AND MAY DECREASE IN VALUE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WARBORN AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE PLATFORM, INCLUDING BUT NOT LIMITED TO LOSS OF FUNDS, DATA, OR BUSINESS OPPORTUNITIES.

10. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Platform shall be resolved through binding arbitration.
